FSMA — Food Safety

FSMA, Explained: Your Questions Answered

Find the rules relevant to your role, distinguish preventive controls from importer verification, and check exemptions before planning the work.

FSMA is implemented through multiple food-safety rules, not a single registration or certificate. Applicable duties depend on the foods, facility activities, and supply-chain roles, with exemptions and modified requirements in some circumstances. Start by identifying those facts before selecting a program or service. FDA FSMA questions and answers.

A role-based map of the major FSMA workstreams

A business can occupy several roles at once. A manufacturer may also import ingredients; a distributor may hold food; a foreign supplier may provide records used by a U.S. importer. Assess the activities separately rather than assuming one filing covers all of them. FDA's FSMA explanations.

  • Human-food operations: assess current good manufacturing practices and the human-food preventive-controls rule.
  • Animal-food operations: assess the separate animal-food preventive-controls framework.
  • Covered produce operations: evaluate the produce-safety rules for the farm and activities.
  • Importers: identify the responsible importer and applicable FSVP or product-specific verification duties.
  • Transportation: examine sanitary-transportation applicability and role-specific responsibilities.
  • Other workstreams: assess food defense, accredited third-party certification, and traceability where relevant.

Registration, food-safety plans, and supplier verification are different

Facility registration identifies a covered facility. A food-safety plan addresses the hazards and applicable controls for operations. FSVP addresses a responsible importer's verification of foreign suppliers. Keeping these distinct prevents a registration number from being treated as proof of a completed safety program. FDA's rule-by-rule guidance.

For covered human-food preventive-controls work, the food-safety plan must be prepared or its preparation overseen by a PCQI. Qualification may come from appropriate training or equivalent job experience; FDA does not require one particular commercial course certificate. FDA PCQI qualification explanations.

Continue with the FSVP importer guide or HACCP basics guide for the relevant workstream.

Check exemptions and modified requirements carefully

Very small or qualified facilities can have modified requirements, but those categories are defined and supported by records; they are not a universal exemption from food-safety duties. Some product-specific activities, including compliant seafood or juice HACCP activities, have particular preventive-controls exemptions. FDA's exemptions and qualified-facility guidance.

Determine the actual food, activity, business structure, and supporting facts. Do not apply a supplier's claimed exemption automatically to your own facility or importer role.

Traceability: distinguish the proposal from the enforcement direction

FDA's current FAQ describes a proposed 30-month extension of the Food Traceability Rule compliance date to July 20, 2028. It separately states that the cited 2026 appropriations law directed FDA not to enforce the rule before that date. A proposed date change and a statutory non-enforcement direction are not the same legal action. FDA's current Food Traceability Rule FAQ.

Covered activities involving foods on the Food Traceability List may require a traceability plan and key data elements for applicable critical tracking events, subject to exemptions. Check FDA's current instructions and your customers' requirements before deciding that no preparation is needed. FDA traceability scope and records guidance.

Prepare an applicability assessment rather than a vague certificate request

List locations, foods, activities, suppliers, and customers, then state which records already exist and what prompted the inquiry. Include the actual FDA or buyer request where one exists, without sending account passwords or confidential material in the initial form.

An agreed scope can focus on the work needed for your role. A guide, course certificate, or consultant's letter is not a substitute for implementing the applicable controls and keeping the required records.

FAQ

Frequently Asked Questions

Is FSMA a single registration or certificate?

No. FSMA is a food-safety law implemented through multiple rules. A registration number or private document does not establish that every applicable obligation is satisfied. FDA guidance

Do all food companies follow the same FSMA requirements?

No. Activities, products, supply-chain roles, and applicable exemptions or modified requirements determine the obligations. FDA guidance

Can a foreign supplier handle the importer's FSVP responsibility?

The responsible importer must be identified. An importer may rely on others for certain activities subject to the required review, but outsourcing work does not simply transfer its responsibility. FDA guidance

Is a PCQI required to take one particular commercial course?

FDA allows qualification through appropriate training or equivalent job experience. A specific commercial training certificate is not the universal requirement. FDA guidance

Are seafood and juice automatically exempt from every FSMA rule?

No. Particular exemptions depend on the food, activities, and compliance with the applicable HACCP requirements. Other obligations may still apply. FDA guidance

What should an FSMA applicability inquiry include?

Describe each location, product, activity, supplier and customer relationship, existing food-safety records, and the question or deadline. The inquiry is a request to discuss scope, not a compliance certification.

From Guidance to Action

Map your obligations before commissioning the compliance work

A useful assessment distinguishes manufacturers, importers, growers, warehouses, and transport participants. We can discuss the applicable workstreams, existing records, and information needed to scope your project.

  • Organize facility activities, products, and supply-chain roles.
  • Discuss relevant registration, U.S. Agent, FSVP, or preventive-controls support.
  • Identify which requirements need a product-specific assessment rather than a generic checklist.
